    Forty-nine-year-old Curtis Buchholz Sr. of Loomis, S.D., 26-year-old Curtis Buchholz Jr. of Mitchell, S.D., and 24-year-old Michael Buchholz of Deadwood, S.D., were released from a Gillete jail on Friday. They had been held overnight on suspicion of involuntary manslaughter in the death of 44-year-old Peter Nels Huke of Mitchell, S.D. But, an autopsy later showed Huke died of a heart attack.     In its decision, the state Supreme Court noted that the judge who sentenced Piper, Circuit Judge Warren G. Johnson of Deadwood, told him that all 12 jurors would have to agree on a sentence if he put his fate in their hands.     Mike Trucano of Deadwood, one of the leaders in the petition drive seeking the statewide vote, filed a sworn statement in state circuit court that opens a new line of argument about why 2,552 signatures were declared invalid by Secretary of State Chris Nelson. State law requires petition circulators to verify before a notary public or other person authorized to administer oaths that all laws were followed in the signature-gathering process.     The referendum petitions original four circulators - Mike Trucano of Deadwood, Don Rose and Pete Thompson of Sioux Falls, and Mark ONeill of Henry - are now seeking a court order requiring Nelson to put the ban on the 2010 ballot. Nelson agreed with Stalleys affidavit that 2,552 signatures are on petition pages showing incorrect expiration dates for the public notaries and, therefore, those signatures arent valid.
